USPTO Fees for Year 2023

This is a government fee table for a patent and design application as of July 3, 2023.  The table below stipulates government fees but does not include any of our attorney fees and other processing fees. It is strongly recommended that you refer to the official federal government fee site for further government fee details.

* $64 for electronic filing applied for small entity. Large entity and micro entity do not apply. ** Government search fee partly discounted if the international search report is issued prior to the national stage filing *** If one or more multiple dependent claims (ex, ..of claim 1 or 2…) included in the claims, an extra government fee is charged for inclusion of one or more multiple dependent claims fee and each multiple dependent claim is calculated as many dependent claims as the number split therefrom. 

Remarks:

1. The government fees above apply to a patent application with total claims up to twenty, independent claims up to three, no multiple dependent claim(s) included, and total sheets of the specification and drawing combined up to 100 pages.
2. Small entity status applies if the entity is either a nonprofit organization or does not, together with all affiliates, have 500 or more employees; and has not assigned, licensed or otherwise conveyed an interest in the invention to a non-small entity.
3. To qualify for micro entity status, applicants need to first qualify as a small entity, and then meet requirements under either “gross income basis” or “institution of higher education bases”. An applicant may qualify for a micro entity under “gross income basis” up to five applications, excluding foreign applications and PCT international applications under the condition that the applicant’s gross income does not exceed four times the median household income, as disclosed in Micro Entity Status Gross Income Limit.
4. A search fee discount $160/$64/$32 (large/small/micro entity) applies for a PCT national stage application if an International Search Report is issued and available..
5. A patent maintenance fee must be paid on time to maintain protection of a patent, which is due at 3.5 years (first  payment), 7.5 years (second payment), and 11.5 years (third and final payment), each from the patent issue date.
